The Dog Exclusion Order: Summary

The Dog Exclusion Order requires people in charge of a dog not to take it into, or keep it in, any area designated by this order.  All the dog ban areas have signs indicating that dogs are not allowed.  The areas where people cannot take dogs (except for assistance dogs) are:

In Parks and Open Spaces

  • All playgrounds, multi use games areas, skate parks, tennis courts, bowls greens and the water bodies in Alexandra Park and St Leonards Gardens
  •  
  • The grounds of Hastings Castle and Hastings Cemetery
  •  
  • Torfield School multi use games area and the access to it
  •  
  • The Peace Garden (Alexandra Park), Hughenden Road Pocket Park; and the fenced part of Duke Green, Duke Road

On the Beach

There are two parts of the beach where you cannot take a dog between 01 May and 30 September.  These are between the Harbour Arm and the Pier and between Warrior Square and The Royal Victoria Hotel in St Leonards (between groynes 32 and 42).  The dog ban areas have not been changed from the previous byelaws and are shown on Map 13a and Map 13b.

The Dogs Exclusion (Borough of Hastings) Order 2008.

The Borough of Hastings hereby makes the following Order;

  1. The Order comes into force on 25 March 2008.
  2.  
  3. This Order applies to the land specified in Schedule 1.

Schedule 1

  1. The grounds of Hastings Castle (as shown on Map 07 cross-hatched in orange); Hastings Cemetery (as shown on Map 08 cross-hatched in orange and pink); Duke Green, the fenced area (as shown on Map 09 cross-hatched in orange); Torfield School Multi-Use Games area and access (as shown on Map 10 cross-hatched in orange): Alexandra Park, the Peace Garden (as shown on Map 11, cross-hatched in orange) and Hughenden Road Pocket Park (as shown on Map 12, cross-hatched in orange)
  2.  
  3. The area of foreshore and beach between, in the east the Harbour Arm and an imaginary line running from the centre point thereof northwards to the life-boat house and, in the west, the eastern side of the Pier (as shown on Map 13a, cross-hatched in green) and that part of St Leonards beach between groyne 32 east-side of Warrior Square to groyne 42, part of the ramp from the upper to the lower promenade outside the Royal Victoria Hotel (as shown on Map 13b cross-hatched in green).

  5. All children's play areas, multi-use games areas, skate parks,tennis courts, bowls greens within the Borough of Hastings and all water bodies within Alexandra Park and St Leonards Gardens.

Offence

3. (1) A person in charge of a dog shall be guilty of an offence if during the times specified in Schedule 2, he takes the dog onto, or permits the dog to enter or to remain on, any land to which this Order applies unless:

  1. he has a reasonable excuse of doing so; or
  2.  
  3. the owner, occupier or other person or authority having control of the land has consented (generally or specifically) to his doing so.

(2) Nothing in this article applies to a person who:

  1. is registered as a blind person in a register compiled under section 29 of the National Assistance Act 1948.  or
  2.  
  3. is deaf, in respect of a dog trained by Hearing Dogs for Deaf People (registered charity number 293358) and upon which he relies for assistance.  or
  4.  
  5. has a disability which affects his mobility, manual dexterity, physical co-ordination or ability to lift, carry or otherwise move everday objects in respect of a dog trained by a prescribed charity and upon which he relies for assistance.

Schedule 2

  1. At all times to land as specified in Schedule 1(a) and (c).
  2.  
  3. At all times between the 1 May and 30 September to land as specified in Schedule 1(b)

(3) For the purpose of this article:

  1. a person who habitually has a dog in his possession shall be taken to be in charge of the dog at any time unless at that time some other person is in charge of the dog; and
  2.  
  3. each of the following is a 'prescribed charity':
    1. Dogs for the Disabled (registered charity number 700454).
    2.  
    3. Support Dogs (registered charity number 1088281).
    4.  
    5. Canine Partners for Independence (registered charity number 803680).

 

Penalty

4. A person who is guilty of an offence under Article 3 shall be liable on summary conviction to a fine not exceeding level 3 on the standard scale.
